DOKRAVE
Terms of Service
General terms intended to form the basis of future DOKRAVE service agreements.
1. Website enquiries
The website is provided for general information and to allow visitors to make enquiries.
Submitting the contact form does not create a client relationship, service contract or obligation to provide services.
2. Separate written agreement
Any future paid engagement must be covered by a separate written agreement identifying the provider and client, scope, deliverables, fees, timetable, assumptions and acceptance process.
Paid work must not begin until the provider is legally authorised to carry out the activity and the applicable agreement is in place.
3. Scope and limitations of testing
Testing and quality assurance are performed within the scope, environments, access, information, test data, time and budget agreed with the client.
Testing can reduce risk and identify defects, but cannot guarantee that software is completely free of defects, vulnerabilities, interruptions or unexpected behaviour.
Findings and recommendations reflect the evidence available during the agreed engagement. They are not a guarantee of future system performance or fitness for every purpose.
4. Client responsibilities
The client is responsible for providing accurate requirements, suitable access, test environments and data, and for maintaining appropriate backups and security controls.
The client remains responsible for business decisions, production deployment, release approval, regulatory compliance and final acceptance of its software.
The client must ensure that it has the necessary rights and permissions to provide access to systems, data and materials used during testing.
5. Liability and limitations
To the maximum extent permitted by applicable law, liability must be assessed in light of the agreed scope, the responsibilities of each party and the specific written service agreement.
To the extent permitted by law, the provider will not be responsible for indirect or consequential losses, loss of profit, loss of business opportunity, loss of data or losses arising from decisions made by the client outside the agreed scope or recommendations.
Testing is a risk-reduction activity, not a guarantee that all defects or security issues will be discovered. The provider does not guarantee uninterrupted, error-free or vulnerability-free operation of software tested.
Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability that cannot lawfully be excluded for intentional misconduct or gross negligence.
Any financial liability cap, remedy or exclusion must be expressly agreed in the applicable written service agreement and must comply with mandatory law.
6. Confidentiality and client data
Confidentiality obligations, access to client systems, handling of personal data, intellectual-property ownership and any data-processing arrangements should be agreed in writing before a project begins.
Clients should not provide production credentials or personal data unless appropriate security and data-protection arrangements have been agreed.
7. Changes and applicable law
These draft terms may be revised before services are offered. Final terms and applicable law will be stated in the relevant service agreement and must comply with mandatory consumer and other applicable legal protections.
